Online Policies and Procedures
 

71B Auto Auction is a NAAA Auction and will abide by the most recent NAAA Arbitration Policy published with the following additions, exclusions, and/or exceptions:

 

I.General Policies

  1. Lot Sales/Outside sales
    1. Any sale in which the Auctioneer does not state the selling price of the vehicle or “sell under the hammer” is considered a “Lot Sale.”
    2. Seller may guarantee Lot Sales, but must do so in writing. Vehicles sold after crossing the block are still subject to the announced conditions noted on the Auction sales receipt. These transactions are subject to the terms noted in the Disclosure/Discovery section of the policies.
    3. Buyers are cautioned to inspect Lot Sale vehicles very carefully and verify announced conditions before purchasing.
 

II.Sale-Light System

  1. Red Light Limited AS-IS
    1. All vehicles with a sale price of $2499 and under will be sold as Red Light vehicles.
    2. All vehicles with a model year 20 years or older will be sold as Red Light vehicles.
    3. All vehicles with mileage over 150,000 will be sold as Red Light vehicles
  2. Blue Light Title Attached/Title Unavailable/Title Absent
    1. This light is used to announce delays regarding the vehicle title.

V.Title Arbitration Policy

  1. Seller has 30 calendar days to produce title to Auction for transfer to Buyer. Any day on or after the 31st day the vehicle title has not been presented to Auction by Seller, Buyer can choose to contact auction and give 24-hour notice of intention to return vehicle. If the title is delivered and presented to Auction before the closing of the business office the day the 24-hour notice expires, the auction sale is completed and considered valid. Buyer must present the physical vehicle at Auction check-in for return before close of the business office the day the 24-hour notice is expired. Vehicle return will be subject to vehicle inspection and return approval by 71B Auction personnel. If Buyer does not present vehicle to Auction check-in within the aforementioned time period, the buyer’s 24-hour notice is considered void; buyer must then give Auction a new 24-hour notice of intention to return vehicle. Seller will be fiscally responsible for paying Auction buyer and seller fee if vehicle is returned for no title. Buyers must return vehicles in original sale condition and vehicles can have no more than five hundred (500) miles above sale odometer listed in auction records. For the purpose of timekeeping auction record of 24-hour notice times will be used. 24-hour notices are subject to auction business days only and do not include holidays or weekends.
  2. Buyers are hereby notified if Seller announces “Late Title – over 45 days,” the same return process applies, however, the Buyer must wait until on or after the 46th day to contact auction and give 24-hour notice of intention to return vehicle.
  3. Sellers will be responsible for the buy fee plus reasonable transportation expenses to and from the Buyer’s dealership to the Auction on vehicles returned for no title.
  4. Buyers must provide verifiable transport invoice(s) and proof of payment(s) to transporter to obtain transportation refunds on vehicles returned for no title. All expenses will be subject to approval by Auction.

  7. Auction will not be responsible for titles mailed from Auction and not received by the Buyer. Auction will assist in replacing titles that are lost or damaged if sent by USPS Certified Mail or any generally accepted overnight carrier.
  8. All units sold through 71B Auto Auction that do not qualify to be categorized as a car, truck, van, or SUV will be sold as Bill of Sale Only on the block. This policy includes but is not limited to: watercraft, motorcycles, scooters, ATV’s, recreational vehicles, go karts, trailers, etc. If a title is present for a unit that is not a car, truck, van, or SUV it will be announced on the block when the unit is offered for sale.

VII. Arbitration Guidelines

Vehicles must be returned to Auction in the same or better condition as when purchased with no more than five hundred (500) miles over the odometer documented on the Auction sale records.
2. Process
c) Auction reserves the right to send vehicle outside auction to a shop unrelated to the Seller or Buyer for diagnosis.
  1. Not Subject to Arbitration
    • Red Light AS-IS vehicles are NOT subject to mechanical, electrical, or cosmetic arbitration
    • Diesel engines and/or diesel engine components are not subject to arbitration
    • Any vehicle(s) towed through the auction are sold on Red Light AS-IS and are not subject to mechanical, electrical, or cosmetic arbitration.
    • Electric or Hybrid Vehicle Battery, Battery Pack, or Charging system components are not subject to arbitration.
  2. 4x2 Disclosure Rule
a) All multipurpose and utility-type vehicles are assumed to be 4x2 unless otherwise announced. However, if a 4x2 multipurpose, utility-type vehicle or pickup has been altered in appearance or stance to resemble a 4x4, a 4x2 announcement will be required. Examples include: new badges, raised suspension, and off-road tires.
 

Sale Day Arbitration

  • Must be requested in person in the Arbitration office within one hour of sale end time.
  • A vehicle may not be arbitrated after Auction has accepted payment for vehicle.

Post Sale Inspection (PSI)

  • Must be requested in the Arbitration office within one hour of sale end time.
  • Vehicles submitted to PSI are not allowed to leave the lot at any time after the sale. This includes Ride C Drive Test Drives. NO EXCEPTIONS
  • $175 set PSI fee covers any arbitrable item for 7 days from auction sale date. Auction sale date is day one.
 

Floor Plan Vehicles

  • Will include an administrative fee of $30.

Duplicate Titles

  • Dealer requesting duplicate title will be responsible for all fees associated with obtaining the duplicate title.
  • Payment of all fees is required before the auction will process any application for a duplicate title.
  • Any duplicate title request over 90 days from sale date will be charged $250.
